We have sent the following FOI to the Council:-

I represent the Save Lupset Greenfields Group which consists over 200 residents who have objected to the Airedale Heights/Milton Road/Milton Crescent/Snapethorpe Primary School greenfields development.

This is a request under the Freedom of Information Act.

Clarification of what information is covered in the Act:-
“The Act covers all recorded information held by a public authority. It is not limited to official documents and it covers, for example, drafts, emails, notes, recordings of telephone conversations and CCTV recordings. Nor is it limited to information you create, so it also covers, for example, letters you receive from members of the public, although there may be a good reason not to release them.
The Act covers information that is held on behalf of a public authority even if it is not held on the authority’s premises. For example, you may keep certain records in off-site storage, or you may send out certain types of work to be processed by a contractor. Similarly, although individual councillors are not public authorities in their own right, they do sometimes hold information about council business on behalf of their council.”

We specify that when we request information it includes ALL information (as clarified above).

Assume that we require the information going back to the year 2000 unless we specifically mention a different timescale.  Dewsbury Road refers to the new houses built of Dewsbury Road.  Redcats refers to the new houses to be built on the former Redcat site.  Airedale Heights/Milton Road refers to the proposed plan for new houses which you refer to 'at the back of Milton Crescent'.

We request a waiver of all fees for this request.  Disclosure of the requested information is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the local government, i.e. the council and is not for commercial interest.

We expect that, given the size of the request, you will take time to collate the information but the Act specifies that this be within the statutory 20-day limit.
As our request concerns important information and considerations regarding any development of the greenfields site then we would ask that you suspend the sale of the greenfields site.

Information Requested:-
1.    Information relating to the original 200 resident objections to the Airedale Heights/Milton Road proposed housing.
2.    Information relating to the 2010 consultation.
3.    Information of who the independent inspector spoke to .
4.    Information relating to the playing fields and the LDF.
5.    Information relating to whether Sport England has been consulted regarding the proposed change/loss of the playing field.
6.    Information relating to contact with local GP practices regarding new houses Dewsbury Road.
7.    Information relating to contact with local GP practices regarding new houses Redcats.
8.    Information relating to contact with local GP practices regarding proposed houses Airedale Heights/Milton Road.
9.    Information relating to road classification of Broadway and any changes for the future.
10.    Reason for not using playing fields by Snapethorpe Primary School children.
11.    Information relating to contact with Snapethorpe Primary School regarding new Dewsbury Road/Redcats/Airedale Heights-Milton Road housing, e.g. school capacity etc.
12.    Information relating to where children will be educated due to Snapethorpe Primary being full.  
13.    Information relating to child safety for children (personal safety, road safety etc) who will have to travel to other schools due to Snapethorpe Primary School being full.
14.    Information relating to the future of the greenfields.
15.    Information relating to contact with LEA regarding the playing fields (current use, future use etc).
16.    Information related to use of the playing fields (current and future), e.g. use of all playing fields for housing.
17.    Information relating to contact with the police regarding new houses Dewsbury Road.
18.    Information relating to contact with the police regarding the new houses at Redcats.
19.    Information relating to contact with the police regarding proposed houses Airedale Heights/Milton Road.
20.    Information relating to contact with Social Services regarding new houses Dewsbury Road.

23.    Information relating to air pollution figures/estimates/future action etc on Broadway, playing field and greenfields at the side of the motorway which is proposed for new housing.  Figures to go back 10 years.
24.    Information regarding any work undertaken to look into health problems caused by air pollution due to Airedale Heights/Milton Road site being so close to the motorway.
25.    Information related to the Council's figure for the estimate of local mortality burden caused by the new housing.
26.    Information regarding the asthma hotspot in area.
27.    Information relating to noise pollution figures/estimates/future action etc on Broadway, playing field and greenfields at the side of the motorway which is proposed for new housing.  Figures to go back 10 years.
28.    Information relating to when Council said that new housing on the greenfields behind Airedale Height/Milton Road site was already a done deal.
29.    Information relating to the accident statistics for Broadway.
30.    Information relating to the gritting of Broadway/Snapethorpe Gate/Milton Road/Crescent for the last 10 years.
31.    Information regarding how much money was spent on preparing the proposed Airedale Heights/Milton Road site.
32.    Information relating to what type of flooding occurs on Broadway, existing residents gardens/houses, the playfields and greenfields in the area.
33.    Information relating to complaints about flooding in the area.
34.    Information relating to why no action taken to fix the flooding.
35.    Information on how the Council plans to mitigate risk of flooding due to loss of trees on Milton Road and the playing fields.
36.    Information that flooding on Broadway is being assessed and plan for action.
37.    Information that flooding study has been undertaken on the proposed new houses on the Airedale Heights/Milton Road new housing.
38.    Information regarding resident usage of greenfields and playing field amenities for last 10 years.
39.    Information regarding any wildlife studies performed in the area.
